Terms of Service


1. INTRODUCTION

In the following terms and conditions, 'we', 'us', 'our' or 'Lost Forest' means Lost Forest ™ by Gillian Corcoran.

The website www.lost-forest.com (known as the 'Lost Forest website') is made available to you (herein known as 'the Purchaser') pursuant to the following trading terms and conditions which are legally binding.

Please read through these terms carefully before making any purchase from the Lost Forest website. Any purchase from the Lost Forest website will indicate your full acceptance of these terms and conditions.

These terms may be modified from time to time and your continued use of the Lost Forest website and any subsequent purchases made shall signify your agreement to be bound by any changes.

‘Lost Forest’ and ‘Looking Glass’ are registered trademarks under the Irish Trade Marks Act.

These terms and conditions are in effect from 1st of January 2018.
 

2. PRODUCT AVAILABILITY

Lost Forest cannot guarantee and accepts no liability in regards to the availability of stock and the time frame involved in delivering any goods or service pursuant to the Purchaser’s order.
 

3. ORDER CONFIRMATION

Confirmation of your order will be sent to your e-mail address. The e-mail will reconfirm all delivery and shipping details, charges and any other relevant information.

It is the purchaser’s responsibility to ensure that all information provided is accurate. I aim to ship within 2-3 business days of orders being placed, however this may vary depending on demand, sickness or illness, or public holidays during the time of order. Please email me immediately should you need to make any changes to your order or if you require your order by a specific time.
 

4. ORDER CANCELLATIONS

Cancellation by Lost Forest:
Lost Forest reserves the right to cancel any order at any time without notification.

Cancellation by Purchaser:
I aim to ship online orders within 2-4 business days of the order being placed. Should you wish to cancel an order after payment has been accepted, please contact me immediately.

If an order is cancelled after dispatch, shipping charges will not be refunded and it will be the purchaser’s responsibility to return the parcel by trackable registered mail at their expense. Cancellations after this time will be at the sole discretion of Lost Forest.

Custom orders cannot be cancelled once payment has been made and the process of making has started. Custom orders are non-refundable.
 

5. BILLING

Transactions for purchases are made through PayPal or Stripe.

All goods remain the property of Lost Forest until they are paid-for in full. Please ensure you enter your contact and delivery details correctly, including your phone number, so that I can contact you if necessary. 
 

6. CURRENCY

All product and shipping prices on the Lost Forest website are quoted and settled in Euros (EUR). Some credit card providers may charge additional fees, please contact your credit card provider or PayPal for more information. Lost Forest is not responsible for these fees.
 

7. CUSTOM TAXES

Purchases shipped to international addresses are subject to custom taxes imposed by your home country. For international orders, the prices listed do not include any overseas duties, customs or import charges which may apply depending on the home country.

Any additional international charges will be at the expense of the Purchaser and will not be covered by Lost Forest. The Purchaser may incur these charges at any time up to 24 months after the goods have been purchased. 

If the Purchaser has refused to pay the custom charge, and the item is returned, shipping expenses will have to be paid again by the Purchaser for the package to be re-sent. A refund will be offered on the cost of the item minus the original shipping charge once the item is recei[-p=pved back in its original condition. If an item is not received, or has been lost in transit, the customer is at the loss of item.
 

8. SHIPPING INFORMATION

Lost Forest ships from the Republic of Ireland with An Post Registered Mail within 2-4 business days of cleared payment. Every parcel will have a unique tracking number assigned to it, which allows the customer to track its journey online. This tracking number is supplied in your shipping notification email.

Postal rates are liable to change due to price increases enforced by the postal company An Post. Lost Forest is not responsible for these increases.

The Purchaser is responsible for providing accurate delivery instructions and address upon placing an online order. If the nominated courier is unable to deliver the Purchaser’s order due to either incorrect information provided by the Purchaser or if there is no one to sign for and physically receive the parcel, a re-delivery fee may apply. This fee will be sent to the Purchaser via a PayPal invoice or a bank transfer for EU customers. There are no refunds if the Purchaser refutes that the package was delivered, while there is definite proof of delivery to the destination address by the courier.

Shipping within Ireland:

Please allow between 1-5 business days for delivery after dispatch notification.
A tracking number will be issued in your order fulfilment via e-mail to the e-mail address you provide, which will enable you to track the progress of your parcel once it has been sent. It is the Purchasers responsibility to track their item.
The package will require a signature on arrival. The Purchaser should make sure that there will be someone at the address provided to sign for it. The Purchaser has the option to include the business address of their workplace in the shipping option to ensure they can personally sign for their package.
Lost Forest cannot accept responsibility for delays in delivery due to unforeseen circumstances such as natural disaster, severe weather warnings, holidays, strike or transport complications, or illness.

International shipping:

9. LIABILITY

To the extent permitted by law, Lost Forest shall not be liable for indirect or consequential losses or expenses suffered or incurred by the Purchaser in relation to the supply of goods. Lost Forest's liability is limited only to the cost of supply or re-supply of goods in accordance with these terms.

I assume no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer, telecommunication equipment or other property caused by or arising from your access to or use of Lost Forest's website.

 

10. NO COMMERCIAL USE

The Lost Forest website is provided for your personal use only. You may not copy, distribute, transmit, display, modify, reproduce, publish, license, transfer, or sell any content, software, products, or services contained within the Lost Forest website. You may not use this site, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own site.
 

11. AGREEMENT

This agreement supersedes any and all preceding agreements between the Purchaser and Lost Forest.


12. CUSTOMER CONDUCT

The Purchaser should conduct themselves in a polite and courteous manner when engaging in discussions with Lost Forest through email or by other methods of communication. Communications with Lost Forest will be immediately ceased if the Purchaser engages in threatening, abusive and disrespectful language. Communications via email or other methods with customers regarding custom orders are to remain private between Lost Forest and the customer. They should not be distributed or discussed openly online for any purposes whatsoever. Inciting slander of the Lost Forest brand will not be tolerated, and will be reported to the relevant authorities, and will be legally investigated.

 

13. PROMOTIONAL CODES

I may occasionally release promotional codes valid for a specified time. These codes are valid for use within the specified time frame only. All conditions applying to each promotional code will be specified at the time of issue. They may be redeemed online on the Lost Forest website only. They cannot be used in any independent Lost Forest stockists.
 

14. ONLINE RETURNS & REFUNDS

If an item is defective upon receipt, the Purchaser should contact Lost Forest immediately and provide photographic evidence of the defect. The item may need to be returned to Lost Forest if further inspection is required. The Purchaser is responsible for return shipping fees. If the item is deemed defective by Lost Forest, returns will only be accepted within 14 days of goods being received. Returns and refunds are not accepted if the Purchaser has had a change of heart, not read the product description, damaged the piece by not following the care instructions, not read the items dimensions or terms of service, or has exceeded the 14 days.

Returns and refunds are strictly not accepted on custom made items, as they have been made to the customers specifications. Returns are also not eligible on discounted items or earrings. Exchanges for other items in store are not allowed once the item has been dispatched.

Items must be returned in their original, unused condition, within their gift box or display card. Proof of purchase must be supplied for all returns/exchanges/repairs. Please pack all exchanges carefully, as Lost Forest cannot be responsible for items damaged in return transit to Lost Forest. An address will be provided to the Purchaser upon email discussion.

The Purchaser is responsible for the cost of returning goods to Lost Forest. Items purchased online cannot be returned to one of Lost Forest independent stockists. Items purchased from one of Lost Forest's independent stockists must be returned to their place of purchase.

If an item is delayed in transit or assumed to be missing in transit, a case will be launched with the shipping provider. Patience is asked of the customer while the case is being investigated. Cases can take 30-60 days to be resolved. An appropriate course of action will be taken upon the resolution of the investigation. There is no refund on shipping costs.

Earrings and made to order items cannot be refunded or returned. All sales are final.
 

15. FAULTY ITEMS

Lost Forest will offer a refund or replacement when an item is faulty or demonstrating a major problem and is unable to be repaired. Minor issues, such as a detachment of jewellery findings, can either be returned to Lost Forest for repair, or the customer has the option to carry out a simple reattachment based on the technical advice provided by Lost Forest. Lost Forest reserves the right to offer to repair an item wherever possible before a refund or replacement is put forward. Shipping costs will be required to be paid by the customer.

Proof of purchase must be supplied for all faulty claims.

Please contact me prior to sending back your goods to notify us of the fault.

Please pack all exchanges carefully, as Lost Forest cannot be responsible for damaged items in return transit.

I will assess the goods when they are received to determine if they are faulty. I will not cover shipping costs or provide a refund for items which are damaged due to mistreatment, not following the jewellery care guidelines or normal wear and tear.

Where goods are deemed to be faulty I will send you a replacement item in a similar colour and style. In the event that the particular item has sold out and cannot be replaced I will contact the Purchaser to determine the most suitable course of action. This may involve providing an alternative item, store credit or full refund to the card, which was used for the original purchase. Shipping costs will not be reimbursed to the Purchaser.
 

16. PRODUCT VARIATION

As described in our product descriptions, every Lost Forest product is carefully handmade using a range of natural materials. This may result in variations in colour, shape and texture between pieces. We endeavour to minimise these variations, however all product images provided on the Lost Forest website should be taken as an example of the design, rather than the individual piece purchased.  A handmade item does not have a machine made, uniform finish. The hand of the maker is evident in each piece to guarantee authenticity of a manual process. This is a charming inherent character of a handcrafted item and will not impact on the integrity, beauty or quality of the finished piece. 
 

17. LINKING TO THE LOST FOREST WEBSITE

You may link to the Lost Forest homepage on the condition you do so in a way that is legal. It must be fair and not intended to damage our reputation or in any way take advantage. You may not suggest any form of association or endorsement with Lost Forest where there is none. I reserve the right to request the removal of links to the Lost Forest website at any time.
 

18. THIRD PARTY LINKS

From time to time, the Lost Forest website may contain links to websites which are not owned, operated or controlled by me. Such links are provided solely as a convenience to you. I am not responsible for any content, materials or other information located on or accessible from any other website.
 

19. INTELLECTUAL PROPERTY

The purchaser will not use, copy or infringe on Lost Forest's intellectual property. This means all intellectual property rights (whether created before, on or after the date of these Terms and Conditions and whether registered or unregistered) in respect of copyright, any patents, trademarks, logos, designs, software, domain names, business or trade names, together with marketing concepts and designs, product knowledge, training systems and materials, protection of confidential information, circuit layouts, inventions, know-how, product or business concepts, details of product development, and any other identifiable result of intellectual endeavour, whether arising under statute or otherwise, and which relates to any of Lost Forest's products or services.
 

20. COPYRIGHT

All designs, content and photographic material are subject to copyright and are wholly owned by Lost Forest. No designs, content or photographic material represented on the Lost Forest website may be used without prior written consent. Lost Forest™ and Looking Glass™  are all registered trademarks.

 

21. ERRORS, INACCURACIES AND OMISSIONS

While I make every effort to ensure the accuracy of information presented there may occasionally be mistakes, inaccurate, or incomplete information on the Lost Forest website. I make no representation as to the completeness or accuracy of information provided on the Lost Forest website.
 

22. JURISDICTION

This contract is made in the Republic of Ireland.
